1. 사문서위조 피고인은 2011. 2. 일자불상경 구미시 C건물 102동 706호 피고인의 주거지에서, 행사할 목적으로 권한 없이 컴퓨터 워드프로세서 기능을 이용하여 ‘부동산교환계약서’라는 제목 하에 “대상물건 (갑) : 소재지 경상북도 구미시 D, 대상물건 (을)1 : 소재지 서울특별시 서초구 E건물 101동 101호, (을)2 : 소재지 서울특별시 양천구 F아파트 C동 703호, 승계채무액 금 : 壹拾四億四阡七百萬원 整” 등으로 기재하고, 특약사항 3항에 “차액 일금 三億九阡五百萬원 整” 등으로 기재하고, 그 교환인 갑에 A, 을에 G, H, I이라고 기재하여 출력한 후 A, G, H, I의 이름 옆에 미리 준비한 인장을 날인하였다.

Accordingly, the Defendant forged one copy of the real estate exchange contract in the above G, H, and I name.

2. On February 201, 201, the Defendant: (a) delivered one copy of the forged real estate exchange contract to K, as in the preceding paragraph, at the residence of K located in the Cheong-do, Cheong-do, Chungcheongnam-do; and (b) exercised the contract as if it were genuine.
