Punishment of the crime

Around November 15, 2013, the Defendant was engaged in the business of manufacturing and installing solar power generation facilities as the representative director of K K in Gangnam-gu Seoul, Seoul, the Defendant entered into a contract for the installation of solar power generation facilities to the electric mar stable owned by the above L L (CN) on the installation of solar power generation facilities for the electric mar stable owned by the above L (CN), around November 27, 2013, and received the down payment in accordance with the agreement, and then the said M andO requested a performance guarantee insurance policy to guarantee the performance of the Defendant’s duty, and the said M andO received the intermediate payment.

가. 피고인은 2014. 3. 17.경 위 (주)K 사무실에서, 기존에 발급받아 둔 P주식회사 대표이사 Q 명의의 별건 이행(계약)보증보험증권을 스캔한 후 컴퓨터를 이용하여 그 피보험자 란을 ‘R N‘, 보험가입금액 란을 ’金 三億四千三百萬 원整‘, 보험기간 란을 ’2014년 03월 17일부터 2014년 04월 30일까지(45일간)‘, 보증내용 란을 ’납품계약에 따른 계약보증금‘, 주계약명 란을 ’S계약(시운전, 성능시험포함)‘, 계약금액 란을 ‘\980,000,000-’, 보증금율 란을 ‘35%’, 작성일자를 ‘2014년 03월 17일’이라고 각각 수정, 입력하였다. 이로써 피고인은 행사할 목적으로 권리의무에 관한 사문서인 P주식회사 대표이사 Q 명의로 된 이행(계약)보증보험증권 1매를 위조하였다. 나. 피고인은 2014. 4. 15.경 위 (주)K 사무실에서, 기존에 발급받아 둔 P주식회사 대표이사 Q 명의의 별건 이행(계약)보증보험증권을 스캔한 후 컴퓨터를 이용하여 그 피보험자 란을 ‘T O‘, 보험가입금액 란을 ’金 四億九千五百萬 원整‘, 보험기간 란을 ’2014년 04월 15일부터 2014년 05월 31일까지(47일간)‘, 보증내용 란을...
