Defendant shall be punished by a fine of KRW 7,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who operates a cleaning service company E within 302 of the building D, Nam-gu, Incheon Metropolitan City.

The defendant, using the fact that the company that submits the lowest estimated price at the time of the selection of the apartment service company, if the apartment management office publicly notifies the bidding price, he requested the same kind of company to make a tender by telephone, and then the other company requested the participation in the bid at a higher price, or requested by the telephone from other same companies to participate in the bid so that the same kind of company can be awarded the bid.

1. On July 20, 201, when the Defendant: (a) on July 20, 201, the public notice of the bid for cleaning services was given in the name of the head of Yeonsu-gu Incheon apartment management office, Yeonsu-gu, Incheon apartment management office; (b) requested that the Defendant participate in the bidding; (c) around that time, G, an enterprise which submitted the tender document at KRW 452,747,760 of the apartment price and received the Defendant’s request by the Defendant, submitted the tender document at a higher price than that of the apartment cleaning service company; and (d) G, an enterprise which received the Defendant’s request by the Defendant, participated in the bidding of the said apartment cleaning service company.

In addition, the Defendant participated in the bidding of each apartment house throughout 12 times from July 13, 2013 from that time as shown in the attached list of crimes (1), and followed the fairness of the bidding of apartment cleaning services through a deceptive scheme.

2. Bidding interference (in response to the request of the other company, submission of bidding documents) was announced by the Defendant on August 27, 2010 by the cleaning service company under the name of the head of the Gyeyang-gu Incheon H apartment management office, and the cleaning service company was commissioned to participate in the bidding by the I company, the same company, according to the above mother.

Around that time, the defendant submitted bid documents at KRW 79,620,360,00 for estimated amount on the side of the above apartment management office, and the I company that requested the defendant to do so.
