Reasons
Punishment of the crime
The defendant is a person who operates apartment cleaning and security service companies in the trade name of "ABF Co., Ltd." in Ansan-si 401.
When the defendant selects apartment service companies, the company that submits the lowest estimated price at the time of the selection of the apartment service companies, and when the apartment management office publicly notifies the bidding price, the company requested the same kind of company to determine the estimated tender price in advance, and in order for the company to be awarded the successful bid, the other company participated in the bidding at a higher price, or in order to have the company participate in the bidding at the request of another company to award the successful bid at a higher price.
1. When the Defendant, on November 24, 2014, announced a tender for security service under the name of the head of the Dong-gu Da apartment management office in Ansan-si, Ansan-si, the Defendant requested the participation of the same company E in accordance with the above mother’s request. The Defendant submitted a tender document at KRW 582,052,80 per annum by the deadline for the receipt of the documents, and E, the company requested by the Defendant, which is the company requested by the Defendant, submitted a tender document at KRW 607,526,880 per annum, which is a higher estimate.
Accordingly, the defendant has harmed the fairness of apartment security service bidding through fraudulent means.
2. When the Defendant, on January 3, 2015, announced a public announcement of the tender for security service in the name of the F apartment management director of the Simpo-si, the Defendant asked E, a same company, to participate in the tender by requesting the participation of the so-called “rur” according to the above mother, and the Defendant submitted the tender document at KRW 345,980,160 per annum by the deadline for the receipt of the documents and submitted the tender document at KRW 361,047,120 per annum by submitting the tender document at KRW 361,04,120 per annum, which is the company requested by the Defendant.
Accordingly, the defendant is fair in bidding for apartment security service through fraudulent means.
