A defendant shall be punished by imprisonment for one year.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Fraud in respect of credit card companies;
A. On November 17, 2014, the Defendant stated to the effect that, by using a mobile phone at C’s house located in the Gyeongbuk-gun B, the Defendant phoneed to the non-employee of the victim Samsung Card Co., Ltd. and carried out as if C, and that “the credit card was lost, which changed its re-issuance.”
However, there was no fact that C lost a credit card, and the defendant was thought to arbitrarily use it by re-issuance of C's credit card.
The Defendant, by deceiving the victim as such, was issued one copy of the credit card in the name of C from the injured party.
B. On November 24, 2015, the Defendant stated to the effect that, by using a mobile phone at C’s house located in the Gyeongbuk-gun B, the Defendant phoneed to the non-employee of the victim Samsung Card Co., Ltd. and carried out as if C, and that “the credit card was destroyed and damaged, which changed its re-issuance.”
However, in fact, C did not have destroyed credit cards, and the defendant thought that C had received a new credit card in the name of C and used it at will.
As such, the Defendant was issued one copy of the credit card in the name of C by deceiving the victim and deceiving the victim.
2. On November 19, 2014, the Defendant violated the law on fraud and credit financing for credit card member stores, the Defendant, at G pharmacy operated by the victim’s name in the Daegu North-gu, Daegu North-gu, Daegu-gu, by deceiving and paying the Samsung Card as above, was issued with medicines equivalent to KRW 3,200 from the victim by deceiving the victim as if he was duly issued a credit card.
