A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. On July 19, 2016, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit, without the consent of the mother C, thought that he/she will use a credit card under his/her name, and applied for one copy of the Samsung Card in the name of Samsung Card to an employee who could not know the name of Samsung Card Co., Ltd. on the same day. On July 21, 2016, the Defendant received the delivery of one copy of the said Samsung Card at the same place.
On July 28, 2016, the Defendant purchased goods from the “Mat” located in Changwon-si F, the Defendant: (a) had the victim, who was unable to know the name operating the said Mt and expressed the said credit card, pay it by the said credit card.
Accordingly, the defendant deceivings the victim and received goods equivalent to 3,500 won from the victim, and used the credit card acquired through deception.
In addition, the Defendant was provided with property or services equivalent to 3,861,360 won in total over 132 times from July 21, 2016 to October 25, 2017, as stated in the List of Offenses (1) from around July 21, 2016 to around October 25, 2017, and used credit cards acquired.
2. On July 21, 2016, the Defendant violated the Act on thief and credit finance business: (a) inputs of Samsung Card, which was acquired by deceit, in the cash payment machine of 148 post offices in Changwon-si, Changwon-si; (b) obtained cash services equivalent to KRW 1,00,000, and stolen it; and (c) around that time, from around August 14, 2017 to around August 14, 2017, the Defendant used the credit card acquired by deceptioning KRW 36,00,000, total cash payments owned by the financial institution that installed the cash payment machine over a total of 51 times, as stated in the attached Table of Crimes (2).
