[Defendant A] The defendant shall be punished by imprisonment for eight months.

그럼에도 불구하고 피고인은 2013. 1. 1.경부터 2013. 7. 9. 20:30경까지 위 게임장을 운영하면서 G로부터 구입한 ‘클라우드’ 게임기 50대(2013. 1. 1.경부터 2013. 6. 말경까지 설치), 성명을 알 수 없는 사람으로부터 구입한 ‘뉴다빈치 게임기’ 20대(2013. 7. 1.경부터 2013. 7. 9.경까지 설치), C로부터 구입한 ‘킹덤 포커’ 게임기 50대(2013. 7. 1.경부터 2013. 7. 9.경까지 설치)를 설치한 후, 위 게임장을 찾은 불특정 다수의 손님들이 게임자동진행장치(속칭 ‘똑딱이’)를 사용하여 위 게임기의 포커 게임을 하면서 정해진 족보에 따라 얻게 되는 점수를 그곳 종업원들이 점수보관증으로 작성해 주면, 피고인이 직접 위 점수보관증에 기재된 점수에서 수수료 10%를 공제하고 환전해 주거나, 위 게임장 옆에 있는 B가 운영하는 F 횟집에서 같은 방법으로 B를 통해 환전해 주는 방법으로 사행행위를 하였다.
