Punishment of the crime

그럼에도 불구하고 피고인은 2013. 7. 초순경부터 2013. 9. 10.경까지 위 게임장을 운영하면서 성명을 알 수 없는 사람으로부터 구입한 ‘킹덤포커’ 게임기 30대, ‘매직캐슬 게임기’ 19대를 설치한 후, 위 게임장을 찾은 불특정 다수의 손님들이 게임자동진행장치(속칭 ‘똑딱이’)를 사용하여 위 게임기의 포커 게임을 하면서 정해진 족보에 따라 얻게 되는 점수를 종업원인 B가 점수보관증으로 작성해 주면, 손님들이 자신과 계약한 환전상인 피고인 C을 통해 게임장 내 또는 게임장 부근에서 위 점수보관증에 기재된 점수에서 수수료 10%를 공제하고 환전해 주는 방법으로 사행행위를 하는 것을 방치하였다.
