A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On September 5, 1995, in order to change the status of stay to overseas Koreans visa (F-4) who entered the Republic of Korea and stayed in the Republic of Korea, the Defendant sought to obtain a national technical qualification certificate issued by the Korea Technology Qualification Examination Institute entrusted by the Human Resources Development Service of Korea, but is not capable of obtaining such certificate. The Defendant applied for the examination by illegal means after introducing the so-called “Broer” to inform the Defendant’s wife of the answer instead of the issue, and applied for the data processing technician written and practical examination by illegal means, the Defendant would give the above Broer KRW 1.5 million to the above Broer.

1. 피고인은 2015. 3. 11. 경 서울 영등포구 버드나루로 110에 있는 서울 남부 상설 시험장에 이르러 그곳 주차장에 대기 중인 C으로부터 시험문제를 촬영하여 위 C에게 전송할 수 있는 휴대폰 1대, 촬영 버튼이 달린 리모컨과 이를 위 휴대폰에 연결하는 구리 선 각 1개, 위 리모컨이 연결된 휴대폰을 부착할 부위가 뚫려 있는 반팔 티셔츠 1 장, 위 C의 일행인 성명 불상자가 알려주는 문제의 정답을 들을 수 있는 무선 이어폰 1개를 교부 받아 이를 장착한 후 그 사용 방법을 듣고, 위 시험장에서 시행된 ‘2015 년 상시 기능사 45회 정보처리 기능사’ 필기 시험장에 입실하여 위와 같이 C으로부터 교부 받은 무선 이어폰을 귀에 착용하고, 휴대폰을 부착한 구멍 뚫린 티셔츠 위에 긴팔 상의를 덧입어 촬영 버튼이 달린 전선을 긴팔 소매로 빼내서 손에 쥔 채로 촬영 버튼을 눌러 컴퓨터 화면에 제시된 시험 문제를 촬영하여 전송하면 시험장 밖에서 대기 중인 위 성명 불상 자가 문제를 대신 풀어 무선 이어폰으로 정답을 알려 주고, 피고인은 수시한 정답을 그대로 컴퓨터 화면에 체크하였다.
