A defendant shall be punished by imprisonment for four months.

Punishment of the crime

The Defendant operated a cell phone sales store of “F” in Seo-gu, Daejeon from November 2015 to December 2015, and from December 2015 to April 2016, the Defendant transferred to Daegu Dong-gu G and operated the aforementioned cell phone sales store.

1. No person who manages or has processed personal information in violation of the Personal Information Protection Act shall divulge personal information he/she has become aware of in the course of performing his/her duties or provide such personal information to any third person without authority, and knowingly receive such personal information for profit

Nevertheless, the Defendant, at around January 29, 2016, deposited KRW 70,00 per unit of personal information, deposited KRW 70,000 per unit of Chinese tourist “H,” and provided a copy of “Z” passport via an e-mail in which the Defendant used the Defendant, even though he knows that the information on the passport of Chinese group tourists, which is a hub for selling foreign passport, entered Jeju-do, entered the Republic of Korea as a non-Visa, and could not come into the territory of the Republic of Korea.

In addition, the Defendant was provided with the passport information of three Chinese group tourists from January 29, 2016 to March 11, 2016, as shown in attached Table 1, and received personal information that he/she came to know in the course of his/her duties for profit.

2. The Defendant: (a) purchased a Chinese traveler’s passport information from the single name “H”, a personal information sales hub, at KRW 70,000 per case; and (b) intended to open and sell so-called largephones using his personal information.

On January 29, 2016, the Defendant without authority, for the purpose of exercising at a “F” store located in Daegu-gu G, Daegu-gu, the Defendant’s “F” telephone for three-party telecom.
