Reasons
Punishment of the crime
From November 2015 to December 2015, the Defendant operated a “F” mobile phone sales store located in Seo-gu Daejeon, Daejeon. From December 2, 2015 to April 2016, the Defendant transferred to Daegu Dong-gu G and operated the said mutual mobile phone sales store.

Nevertheless, at around December 8, 2015, the Defendant’s “F” store located in Daegu-gu G, Daegu-gu, for the purpose of using his personal information and taking profits by opening a prepaid cell phone with knowledge of the fact that the information on the passport of Chinese group tourists who sold this “H”, a hub for selling foreign passport, enter Jeju-do as a visa without permission, and entering Jeju-do as a main part of the Republic of Korea, with a view to using his/her personal information and taking profits by opening his/her prepaid cell phone. The “210,000 won” stated in the facts charged as KRW 210,00 in the facts charged as “210,000,000” is a clerical error.
B Deposit and provision of a copy of the passport “K (number: L), “M (number: N)” and “O (number: P)” to Chinese tourists was made through e-mail with the Defendant’s use.
In addition, the Defendant received total of 434 Chinese tourists’ passport information from November 17, 2015 to April 5, 2016 from around November 17, 2015, and received personal information that he/she came to know in the course of his/her duties for profit-making purposes, as shown in attached Table 1.
2. The Defendant purchased the passport information of Chinese travelers from the above H, “H,” a hub for sales of personal information, at least 70,000 won per unit, and attempted to open and sell the so-called large phone using his personal information.
