A Imprisonment for one year, and each of the defendants C shall be punished by imprisonment for ten months.
However, this judgment is delivered to Defendant C.
Reasons
Punishment of the crime
A business owner who operates a child-care center under the Act on the Requirements for Supporting Training Expenses for the Development of Vocational Skills of Business Operators may outsource a child-care teacher who is an employed employee to another training institution with the expenses incurred in training, and may receive subsidies from the Minister of Employment and Labor if the child-care teacher has completed the training. In order to receive such subsidies, the business owner shall enter into an entrustment contract for the workplace skill development training with the educational institution certified by the Human Resources Development Service of Korea and the infant-care teacher who has completed the training course, and shall actually pay the training expenses to the entrusted training institution. If the child-care teacher who is a person subject to education directly finds the training and receives the education, the child-care teacher shall attend at least 80/100 of the training hours recognized by the relevant training course and complete the relevant training course.
Defendant B, from around 2012 to November 2013, the second floor of the Seo-gu Incheon Metropolitan Building, was entrusted by the business owner operating a childcare center with workplace skill development training for childcare teachers, and operated the FLifelong Educational Facility, which is an educational institution that receives training fees from the business owner, and Defendant C was in charge of applying for workplace skill development training by proxy while working as an auditor of the FLifelong Educational Facility.
When the Defendants become aware that the head of a child-care center, who is an employer, can receive a subsidy from the Ministry of Employment and Labor in operating the FLifelong Educational Facilities, they can get a refund of the educational expenses to the head of the child-care center.
