Defendants shall be punished by imprisonment for six months.

Punishment of the crime

A business owner who operates a child-care center may outsource his/her training expenses to another training institution and require the relevant training institution (entrusted training institution) to conduct workplace skill development training for the child-care teacher, and if the child-care teacher has completed the training, the expenses may be subsidized by the Minister of Employment and Labor. In order to receive the subsidy, the business owner shall enter into an agreement with the training institution certified by the Human Resources Development Service of Korea on the entrustment of workplace skill development training for the child-care teacher, and shall actually pay the training expenses to the entrusted training institution. If the child-care teacher who is subject to the education directly finds the entrusted training institution and receives the education, he/she shall attend at least 80/100 of the training hours recognized by the relevant training institution and complete the relevant training course.

Defendant

A From July 2013 to September 2013, an employer who operates a child care center in Seocheon-gu, Seocheon-gu, Seoul, entrusted the workplace skill development training for child care teachers and provided training for infant care teachers who are workers in the child care center and operated E corporation, which is an educational institution that receives training expenses from employers. Defendant B is a person in charge of workplace skill development training, such as the attendance management of infant care teachers, preparation of various documents, etc.

When the Defendants become aware that the head of the childcare center, who is a business owner, can receive the cost of workplace skill development training from the Ministry of Employment and Labor, the Defendants provided that the head of the childcare center can receive the cost of education from the Ministry of Employment and Labor, and thus, they provided the E company with the education for the childcare teacher, and provided the E company with the job of applying for workplace skill development training

Defendants, together with the E office around September 10, 2013, and the F Child Care Teachers affiliated with the F Child Care Center.
