1. Of the judgment of the court of first instance, the part against the defendant in excess of the amount ordered to be paid below shall be cancelled.
Reasons
1. Basic facts
A. From August 14, 1995, Plaintiff A was serving in the Defendant Corporation from January 2, 1999, Plaintiff B from January 2, 199, Plaintiff C from October 28, 1997.
B. The Plaintiffs consented to the payment of wages under the remuneration regulations set by the Defendant and received the benefits in accordance with the said remuneration regulations. The Defendant’s remuneration regulations related to the Plaintiffs’ claims are as follows.
Article 4 (Definitions of Terms)
2. The term “basic pay” means the sum of a job-grade and continuous service pay;
4. The term "period of continuous service" means a basic salary paid by salary class according to the period of service;
6. The term “ordinary wage” means the sum of the basic wage and bonus, long-term continuous service allowance, and physical training expenses;
Article 13 (Kinds of Allowances) (1) Types of allowances to be paid to executives and employees are as shown in attached Table 4.
(2) The bonus of executives and employees shall be paid 400% per annum of the basic salary, and shall be paid in four installments each year ( March, June, September, and December).
(3) Bonuses shall be paid from the first day of each quarter to executives and employees who have worked for the end of the quarter (hereinafter referred to as "period subject to payment").
Provided, That for a person falling under any of the following subparagraphs, the amount equivalent to the period of actual service shall be calculated and paid in accordance with the following formula:
Basic pay x working period (number of days) / Payment period (number of days)
1. Persons newly appointed or reinstated, who have worked for a period subject to payment of not less than 15 days;
2. Persons who have worked for 15 days or more during the period subject to payment and are suspended from office;
3. Persons who have worked for at least 30 days during the period subject to payment.
4. A person who is resting for work (attached Table 4);
5. Technical allowances: Professional engineer, doctor’s (monthly) doctor’s degree, master’s degree, master’s degree (monthly), 30,000 won / technician(monthly) 20,000 won / 10,000 won / employees engaged in other technical affairs: Basic pay x 220% (annual) 】 overtime allowances x 1.5/209 x ordinary wage x 1.209 x working hours (on December 2010 x ordinary wage x 1.84/184 x working hours): 130,00 won.
