1. The defendant's money, other than plaintiffs 56 A and 71 B, are the money in the form of the quoted amount in the attached Table 2 sheet to the remaining plaintiffs.
Reasons
1. Basic facts
A. The defendant is a local public enterprise established under the Local Public Enterprises Act and the Guro-gu Seoul Metropolitan Government Ordinance on the Establishment and Operation of the Guro-gu Seoul Metropolitan Government Facilities Management Corporation with the purpose of contributing to the promotion of the welfare of Gu residents by efficiently managing and operating facilities designated by the head of Gu
B. From December 2013 to November 2016, the Defendant paid only the amount calculated by including only the amount of basic pay, job bonus, and efficiency allowance (hereinafter “basic pay, etc.”) as ordinary wage in accordance with the Defendant’s remuneration regulations among various allowances paid to the Plaintiffs in granting additional wages for overtime night work (hereinafter “excess work allowance, night work allowance,” and holiday work allowance”) and annual paid leave (hereinafter “annual paid leave allowance”), to the Plaintiffs.
The definitions of terms used in the provisions of Article 2 (Definition of Terms) of the Guro-gu Seoul Metropolitan Government Remuneration Regulations for Facilities Management Corporation shall be as follows:
1. The term “repair” means the sum of the basic pay and various allowances;
Provided, That the executives and employees subject to application of the annual salary system mean the sum of annual salary and various allowances.
3. The term "basic salary" means a basic salary paid by position or rank (including positions; hereinafter the same shall apply) according to the degree of difficulty and responsibility of duties, period of service, etc.;
7. The term “ordinary wages” means basic wages, class allowances, and efficiency allowances;
Article 13 (Date of Payment of Remuneration) (1) Remuneration shall be paid on the 20th of each month.
Article 23 (Kinds of Allowances) (1) Types of allowances paid by the GEPS shall be as follows:
