A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From January 6, 2012 to March 27, 2014, the Defendant served as the chief operating officer of the G branch of the Korea Shipping Association, and the G is a person in charge of vessel safe management and direction and supervision of G vessel operation managers (hereinafter referred to as “operation manager”).

On July 1961, the Korean Shipping Association is a juristic person established under the Korean Shipping Association Act, the maritime transportation act, the Korean Shipping Association Act, and the Passenger Ship Safety Management Guidelines. The Korean Shipping Association is responsible for managing the safe operation of passenger ships, and the operations managers belonging to the above associations are responsible for managing the safe operation of passenger ships.

A navigation manager appointed by the Korea Shipping Association is obligated to faithfully perform the management of the operation of passenger ships by taking necessary measures to ensure the safety of passenger ships, such as maintaining the order of entry into and departure from port, excess of the seating capacity, verification as to whether the number of passengers is excessive, etc., and to faithfully perform the management of the operation of passenger ships. Upon receipt of a safety inspection report on passenger ships prior to departure from port (hereinafter “inspection report prior to departure”) from the captain, he/she shall provide the captain with information on the weather conditions of the relevant sea route, the number of passengers on board, the load and loading status of cargo, the status of facilities of the vessel, etc. are the same as the details of the report. If the number of passengers on board and the loading capacity of the vessel are different from the actual contents, necessary measures, such as leaving the vessel, shall be taken, and if other matters are likely to hinder the safe operation of passenger ships, the core details of the on-site visit, such as information provision, inspection matters, and cadastral matters, shall be recorded and maintained by the head of the competent maritime police station immediately.
