Punishment of the crime

[Public invitation relationship] The Defendant assumes false calls from many unspecified persons in the Republic of Korea to conduct a test, etc., and sent them the following collection measures: (a) to withdraw all money from a bank to be suspected of having been used in the Internet fraud case; and (b) to the employees of the Financial Supervisory Service to withdraw money from the bank; and (c) to withdraw money from the bank;

직접 돈을 건네받는 속칭 ‘ 보이스 피 싱’ 조직의 일원으로서, 위 조직은 성명 불상자( 일명 ’E‘ )를 총책으로, 성명 불상자( 일명 ’F‘) 가 보이스 피 싱 범죄 실행을 총괄하면서 아래 ’ 수거 책‘ 및 ’ 전달 책 ‘에게 모바일 메신저 인 ’ 위 챗 ‘으로 구체적 범행 지시를 하는 ’ 실행 책‘ 의 역할을, G는 금융감독원 직원을 사칭하며 피해 자로부터 돈을 받는 ’ 수거 책‘ 역할을, 중국인 H은 위 G를 감시하며 위 G로부터 돈을 받아 위 조직에 전달하는 이른바 ’ 레이 더‘ 및 ’ 전달 책‘ 역할을, 피고인은 G 등 수거 책을 모집하고 그 대가로 범행으로 편취한 금원의 약 10%를 취득하는 이른바 ’ 모집 책‘ 의 역할을 담당하였다.

[ 구체적 범죄사실] 피고인은 2016. 8. 하순경 인천 남구 주안로 95-19에 있는 지하철 주안 역 부근에 있는 상호 불상의 커피숍에서, G 에게 보이스 피 싱 조직 가담을 권유하여 G를 ‘ 수거 책 ’으로 보이스 피 싱 조직 범죄에 참여하게 한 다음, G로 하여금 금융감독원 직원을 사칭하는 데 사용할 증명사진 및 가방 등을 준비하게 하고 위 보이스 피 싱 조직과의 연락 및 지시사항 전달을 위하여 G의 휴대전화에 모바일 메신저인 ‘ 위 챗’ 을 설치하게 하였다.
