1. 피고인 A, 피고인 B의 공동 범행 피고인들은 2018. 7. 20. 04:20경 경주시 D에 있는 E식당 앞 노상에서 사촌동생인 F(여, 22세)으로부터 ‘몸싸움이 났으니 빨리 와 달라.’는 연락을 받고 현장에 도착하여 F을 데리고 가려 하였으나, F의 일행인 피해자 G(22세)이 이를 가로막으며 시비가 생기자 피고인 A이 주먹으로 피해자의 얼굴을 1회 때린 후 발로 피해자의 몸통을 걷어차고, 피해자가 넘어지자 재차 발로 피해자의 얼굴과 몸을 수회 걷어차고, 피고인 B이 이에 합세하여 발로 피해자의 몸을 걷어찼다.

2. 피고인 B 피고인은 제1항 기재 일시, 장소에서 G의 일행인 피해자 H(23세)이 위와 같이 G이 넘어져 맞고 있는 모습을 보고 달려오자, 주먹으로 피해자의 얼굴을 1회 때린 후 발로 1회 걷어차고 피해자가 넘어지자 재차 발로 피해자의 얼굴과 몸을 수회 걷어찼다.
