Punishment of the crime

1. The summary of the facts charged is the co-owners of the three-story real estate D and C in Ansan-gu (hereinafter “instant real estate”).

On December 19, 2017, the Defendants conspired to prepare a lease agreement in the name of the Defendants and C without notifying C of the fact that C was opposed to the lease agreement, while entering into a lease agreement with H on the instant real estate in the etel F G Licensed Real Estate Agent Office in Ansan-si, 2017.

The Defendants, at the G Licensed Real Estate Agent Office, had I, know of the fact, enter “The monthly rent contract for the office (hereinafter “instant contract”)” in the “the co-titled person: D, J, resident registration number K, and name C” in the “The office monthly rent contract for the office (hereinafter “instant contract”) by means of a computer, and then had C affix the seal of the name attached thereto, and then deliver it to H.

As a result, the Defendants conspired to forge a monthly rent contract in the name of C, a private document on the duty of rights, and delivered it to H without knowledge of the fact.

2. On December 26, 2017, the Defendants asserted, the lessee, and the partners of the lessee, set up the instant contract on December 26, 2017, which was not the remainder of December 19, 2017 as indicated in the contract.

At the time, the Defendants explained that “A real estate agent and lessee did not attend without the consent of C, and only the Defendants will enter into a contract,” but the real estate agent I arbitrarily assembled the seals in C’s name at the seat, i.e., the seal affixed to C’s name among the instant contract.

The defendants raised objections on their job so that C seal parts can be cut off, and the seals are invalid.

Therefore, the defendants did not have the intention to forge private document, and there is no fact that they had the real estate agent I, who is not aware of the fact, affix C seal.
