A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
In collusion with the name-free loan hub, the Defendant conspireds with the name-free loan hub, thereby forging the lease contract, thereby receiving a loan for the lease fund.
1. Forgery of private documents and the uttering of a falsified investigation document;
A. On July 26, 2014, the Defendant forged private documents: (a) at the office of certified intermediaries C located in Ansan-si, and with the one with whom it is impossible to know the name to be carried out as the fake lessor who was introduced by Brazil-do; and (b) at the location of the real estate for the purpose of obtaining a loan for lease, the Defendant stated in the column for the location of the real estate as “D 101 Dong 1302 during Ansan-si, Gyeonggi-do; (c) “this0 million won” in the deposit column; (d) “from August 23, 2014 to August 23, 2016”; and (e) on the date date of preparation, the Defendant affixed a seal on each’s name “E” and “A” in the lessor column, respectively.
Accordingly, the defendant, in collusion with his name in order to exercise his rights and duties, forged one chapter of the apartment lease contract under the name of lessor E, which is a private document related to rights and duties.
B. On September 24, 2014, the Defendant: (a) at the Dong F-dong Office in Ansan-si, the Defendant: (b) applied for a loan loan to G by the victim KB non-life insurance company that is unaware of the fact that the written lease contract of apartment under the above E, which was forged as described in the foregoing paragraph (a), was duly formed; and (c) applied for a loan of the entire loan to G.
Accordingly, the defendant exercised the lease contract of apartment in the above E name.
2. On August 27, 2014, the Defendant violated the Resident Registration Act: (a) at the Dong Fdong Office in Ansan-si, the fact was stated as having been transferred to the said apartment in the resident registration transfer report as if he had been transferred to the said apartment even though he did not have been transferred to the Dong F Office in Ansan-si, the fact was stated as having been transferred to the said apartment.
Accordingly, the defendant reported false facts on the defendant's resident registration.
3. The Defendant committed fraud in collusion with a name-free loan hub.
