A defendant shall be punished by imprisonment for not less than one year and six months.

1,450,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

[criminal history] On April 15, 2014, the Defendant was sentenced to one year of imprisonment with labor for a violation of the Narcotics Control Act at the Chuncheon District Court, and completed the execution of the said sentence at the Chungcheong House on February 17, 2015.

1. Sale and purchase of a clopon (one copon (one copon; hereinafter referred to as "copon");

A. On December 24, 2015, the Defendant deposited KRW 200,000 in the Nong Bank account (Account Number E) in the name of D used by C on December 24, 2015, and received approximately 0.3 grams from C on the street following a G bank located in Yangcheon-gu Seoul Metropolitan Government F on December 25, 2015.

B. On December 27, 2015, the Defendant deposited KRW 200,000 in the G bank account (Account Number H) in the name of D used by C at around 00:10,000 won, deposited KRW 2.50,000 won in the instant account on December 30, 2015, and received approximately 0.7 grams from C before the opening of J Station located in Guro-gu Seoul Metropolitan Government I on December 30, 2015.

On December 31, 2015, the Defendant deposited KRW 200,000 in the G bank account (Account Number H) in the name of D used by C around 19:10 on December 31, 2015, and received approximately 0.3 grams from C on the street following G bank located in Yangcheon-gu Seoul Metropolitan Government F on the same day at around 21:20 on the same day.

On January 7, 2016, the Defendant deposited KRW 2.50,000 in the Nong Bank account (Account Number E) in the name of D used by C around January 15:32, 2016, and received approximately 0.4 grams from C in the street near the Seoul Yangcheon-gu Seoul Metropolitan Government on January 8, 2016.

E. On January 14, 2016, the Defendant deposited KRW 2.50,000 in the form of the Nong Bank account (Account Number E) in the name of D used by C on January 14, 2016, and received approximately 0.4 grams from C in the vicinity of L in Gangseo-gu Seoul Metropolitan Government on the same day at around 21:11.

Accordingly, even if the Defendant is not a narcotics handler, he purchased and sold 2.1g of philophones, a local mental medicine, in five times over 1,350,000 won.
