A defendant shall be punished by imprisonment for a term of one year and four months.

1,830,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

[criminal history] On October 16, 2013, the Defendant was sentenced to imprisonment with labor for a violation of the Narcotics Control Act (compact) at the Seoul Southern District Court on the grounds of the violation of the Act on the Control of Narcotics, etc., and completed the execution of the said sentence in the official prison on June 26, 2015.

[Criminal facts]

1. On December 1, 2015, the Defendant: (a) deposited KRW 200,000 in the National Bank Account (Account Number E) in the name of D used by C on December 1, 2015; (b) around 01:24, the Defendant deposited KRW 00,000 in the face-to-face account; (c) around 03:00 on the same day, “G” in the Seoul Yangcheon-gu Seoul Metropolitan Government F on the street of parts located around the specialty store; and (d) 0.4g of the face-to-face phone from C on the street near the specialty store.

2. On December 6, 2015, the Defendant: (a) around 20:10 on December 6, 2015, the Defendant: (b) sent C at the street near the I Station located in the Nam-gu Incheon Metropolitan City, and (c) deposited KRW 1.40,000 won in the Agricultural Cooperative Account (Account Number K) in the name of D used by C by posting the phone; and (d) received approximately KRW 0.3 grams from C.

3. On December 30, 2015, the Defendant: (a) deposited 200,000 won of philopon into the above national bank account in the name of D used by C around December 30, 2015; and (b) received approximately 0.4g gramlopon from C in front of “M hospital” located in the Nam-gu Incheon Metropolitan City L around 20:00 on the same day.

4. On December 31, 2015, the Defendant, around December 31, 2015, deposited KRW 200,000 in the instant national bank account in the name of D used by C around December 18:34, 2015, and received approximately 0.4 grams from C in the O station located in Guro-gu Seoul Metropolitan Government, around 21:00 on the same day.

5. On January 1, 2016, the Defendant: (a) deposited KRW 200,000,000 from the instant national bank account in the name of D used by C around January 1, 2016; (b) received approximately 0.4g opon from C in Q Station located in Seocheon-si P around 23:30 on the same day.

6. On January 9, 2016, the Defendant, who purchased and sold phiphones, proceeds from the phiphones into the account in the name of D used by C around January 21:43, 2016.
