A defendant shall be punished by imprisonment for a maximum term of one year and six months, and a short term of one year.
Reasons
Punishment of the crime
【2016 order 1822】
1. On May 21, 2016, the Defendant: (a) opened a entrance that was not corrected in the office of a pastor of “D church” located in Daegu Northern-gu, Daegu Northern-gu; (b) opened the entrance; and (c) cited KRW 450,00 in cash from the victim’s house located in the office by using the gaps in which the surveillance of the victim E, who is a church pastor, was neglected; and (d) stolen the same.
In addition, as shown in attached Table I, the Defendant stolen the victims' property from around that time to June 8, 2016, on a total of eight occasions, from around that time.
2. On May 21, 2016, the Defendant infringed upon a structure, as stated in paragraph (1), opened a entrance that was not corrected by the “D church” located in Daegu Northern-gu C on May 21, 2016, and entered the church. In addition, the Defendant intruded the structure managed by the victims three times in total from around that time to June 7, 2016, as shown in Appendix II.
3. On May 25, 2016, the Defendant attempted to steal property by removing a gate installed at the “H” restaurant operated by the victim G in Ulsan-gu, Ulsan-gu, Seoul-gu, from the front and rear in the front of and rear the entrance, which had been corrected at around 04:45 on May 25, 2016.
However, it did not go through the wind that the corrective device has not been removed, but was attempted.
In addition, as shown in the attached list III, the Defendant attempted to steal the property by impairing the structure managed by the victims four times from around that time to May 29, 2016, as shown in the attached list III.
4. On May 25, 2016, around 05:40 on May 25, 2016, the Defendant: (a) removed the entrance opened at the “K” restaurant operated by the victim J in Ulsan-gu, Ulsan-gu; (b) obstructed the entrance by front and rear-down, and intrudes into the restaurant within the restaurant; (c) took one cell phone of the victim’s “belle” on the water purifier, which is owned by the victim on the water purifier, and stolen the entrance.
