A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who sells bags, women's clothes, miscellaneous articles, etc. at the 'C' store located in the first floor of Busan Jung-gu.

피고인은 2015. 4. 22. 16:00경 위 장소에서 서울 동대문시장 불상의 중간 공급업자 등으로부터 상표권자인 프랑스 ‘루이비똥말레띠에’사, ‘샤넬’사, ‘지방시’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, ‘몽클레어 에스.알.엘’사, 룩셈부르크 ‘프라다 에스.에이’사, 영국 ‘버버리리미티드’사, ‘멀버리 캄페니 리밋티드’사, 이탈리아 ‘살바토레 페라가모 에스.피.에이.’사, 프랑스 ‘세린느’사, `고야드 쌩-또노레`사, 룩셈부르크 ‘보테가베네타 인터내셔널 에스.에이.알.엘’사, 미국 ‘톰브라운 인코포레이티드’사, 스위스 ‘필립 플레인’사, 일본 ‘가부시끼가이샤고모데갸루송’사, 프랑스 ‘끌로에 소이에떼 빠 악씨옹 심플리피에’사가 각각 대한민국 특허청에 그 지정 상품을 가방, 지갑, 티셔츠, 점퍼, 선글라스 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON)', '샤넬(CHANEL)', ’지방시(GIVENCHY)', ‘구치(GUCCI)’, '몽클레어(MONCLER)', ‘프라다(PRADA)', '버버리(BURBERRYS)', '멀버리(MULBERRY)', ‘살바토레 페라가모(SALVATORE FERRAGAMO)’, '세린느(CELINE)', `고야드(GOYARD)`, ‘보테가 베네타(BOTTEGA VENETA)', '톰 브라운(THOM BROWNE)', ‘필립 플레인(PHILIPP PLEIN)', '꼼데가르송(COMME DES GARCONS)', '끌로에(CHLOE)'와 동일ㆍ유사한 상표가 부착된 가방, 지갑, 티셔츠, 점퍼, 선글라스 등을 공급받아 판매하고 남은 별지 목록 기재 85점(정품 시가 약 6,625만원)을 판매 목적으로 보관하였다.
