피고인은 2016. 8. 18. 15:50경 위 장소에서 불상의 중간공급업자로부터 상표권자인 프랑스 ‘루이비똥 말레띠에’사, 프랑스 ‘샤넬’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, 룩셈부르크 ‘프라다 에스.에이.’사, 스위스 ‘보테가 베네타 에스에이’사, 프랑스 ‘이브 생 로랑’사, 영국 ‘멀버리 캄페니 리밋티드’사, 스위스 ‘발리 슈허파브리켄 아크티엔게젤샤프트’사, 스위스 '카르티에 인터내셔널 아게‘사, 스위스 '로렉스 에스아‘사, 스위스 '휴블롯 소시에테 아노님, 제네브‘사, 이탈리아 ‘살바토레 페라가모 에스.피.에이.’사가 각각 대한민국 특허청에 그 지정 상품을 가방, 지갑 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON)', '샤넬(CHANEL)', ‘구치(GUCCI)’, ‘프라다(PRADA)', ‘보테가 베네타(BOTTEGA VENETA)', ‘이브 생 로랑(Yves Saint Laurent)’, ‘멀버리(Mulberry)', ‘발리(BALLY)', ‘카르티에(CARTIER)', ‘로렉스(ROLEX)', ‘휴블롯(HUBLOT)', ‘살바토레 페라가모(SALVATORE FERRAGAMO)’와 동일유사한 상표가 부착된 가방, 지갑 등을 공급받아 판매하고 남은, 별지 범죄일람표 기재와 같이 37점(정품 시가 약 7,180만 원)을 양도 또는 인도하기 위하여 소지하였다.
