A defendant shall be punished by imprisonment for not less than one year and six months.
The defendant shall receive 160,000 won from the defendant to B who is an applicant for compensation with the money obtained by deceit.
Reasons
Punishment of the crime
[Criminal Power] On August 23, 2018, the Defendant was sentenced to one year of imprisonment for a crime of fraud at the Suwon District Court, and the execution of the sentence was terminated by the Innju Prison on April 16, 2019.
【Criminal Facts】
1. Around August 4, 2019, the Defendant made a false statement to the effect that “Around August 4, 2019, the Defendant visited the victim S who published a notice to the effect that QR car page using smartphones, etc. at the Defendant’s house located in P and then wanting to purchase the “BR type” in the bulletin board, and then sending the “BR type” to the victim S who sent the notice to the victim S. will send the value of the article first.”
However, in fact, the defendant was intended to receive money from the victim and did not possess the Brazil punishment. Therefore, even if he received the money, he did not have an intention or ability to send the goods promised to the victim.
Nevertheless, the Defendant, as above, by deceiving the victim as above, received 540,000 won from the victim to the T account (U) in the name of the Defendant at around 21:44 on the same day, and acquired 7,629,200 won in total from the 25 victims in the same manner as in the attached Table 1 from September 19, 2019.
2. Around September 5, 2019, the Defendant, “Around September 5, 2019, the Defendant,” written a letter “assumed from the Defendant’s house located in P and P, to Q Kaf,” saying, “I will send things if you send the price of the goods.”
However, even if the defendant receives the price of goods, he did not have the intention or ability to sell it normally.
Nevertheless, the Defendant deceiving the victim as above and received 230,000 won from the W bank account (X) in the name of A around September 5, 2019, as well as from around that time to September 27, 2019, a total of 15 victims, such as the list of crimes in attached Table 2.
