Defendant shall be punished by a fine of two million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
Defendant, B, and C provided an account to be used for a crime, and Defendant and C provided an account at the Internet goods transaction site to the victims, and offered to use the money in installments after receiving the money from the victims to B.
1. On February 29, 2016, the Defendant, along with B and C, posted a letter to the DPC located in Seocheon-gu, Seocheon-gu, Gyeonggi-do, stating that “Sales of vehicle-type monitors” on the Internet EF car page, and false statement was made to the victim G who contacted with B stating that “When sending the price of the goods, sending the said monitors.”
However, there was no intention or ability to send the above things even if the defendant, B, and C did not possess the above things and received money from the victim.
Nevertheless, the Defendant, along with B and C, by deceiving the victim as above, received 70,000 won from the victim to the Nonghyup Bank (H) account in the name of B on the same day.
2. On February 29, 2016, the Defendant, along with B and C, posted a notice on DPC located in Seocheon-gu, Seocheon-gu, Gyeonggi-do, stating that “The PC will sell the main body of the PC in the Internet EF car page,” and the Defendant reported it to the victim I who visited the victim I.
However, there was no intention or ability to send the above PC to the victim even if the defendant, B, and C did not possess the above goods and received money from the victim.
Nevertheless, the Defendant, along with B and C, by deceiving the victim as above, obtained 400,000 won from the victim to the Nonghyup Bank (H) account in the name of B on the same day.
3. On March 1, 2016, the Defendant, along with B and C, reported and contacted with DPCs located in Seocheon-gu, Seocheon-gu, Busan, Gyeonggi-do, to the effect that “the purchase of spackers and HC converters” posted by the Victim K on the Internet Ek page, and that “the purchase of spackers and HC converts” is the price for the goods to the victim.
