A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the representative director B of the indoor tech fishery chain Co., Ltd.

In the case of interior construction business, the defendant had a construction business registration certificate exceeding a certain amount, so he had the intention to forge the construction business registration certificate in order to utilize it in the interior construction business.

Therefore, on October 2017, the Defendant: (a) removed image files of a construction business registration certificate in the name of the head of Yeongdeungpo-gu Office, which was searched and searched via the Internet; and (b) operated an image file of the construction business registration certificate in the manner of gathering the trade name, representative, location, and registration number of the company, which is recorded in the image of the construction business registration certificate cut down as above, and recording the said B’s information, and stored it in the USB.

On July 5, 2019, in order to use the image files of the construction business registration certificate so operated as above in the proposal for joint business participation, the Defendant sent them by e-mail to C manager D and then sent them to C manager D. On July 5, 2019, the Defendant sent the above image files to E who operates tin company again on July 5, 2019, and had E output the image files of the said construction business registration certificate as a printer and submit them to the Yeongdeungpo-gu Office as a civil petition accompanied by a civil petition requesting confirmation as to whether the constructor is registered.

Accordingly, the defendant, for the purpose of exercising his official document, forged one copy of the construction business registration certificate under the name of the head of Yeongdeungpo-gu Office, Yeongdeungpo-gu.
