1. Basic facts

A. The Plaintiff’s transition process 1) “Yan River Repair Association” was enacted on August 22, 194 by the former Decree of the Shipbuilding Repair Association (Ordinance No. 2, July 21, 1917) and was repealed by the implementation of the Land Improvement Project Act on January 21, 1962; hereinafter “former Decree of the Shipbuilding Repair Association”).

The name was changed from January 1, 1957 to the Young-dong Repair Association. The former Land Improvement Project Act (amended by Act No. 948, Dec. 31, 1961; repealed by Act No. 2199, Jan. 12, 1970; hereinafter “former Land Improvement Project Act”).

A) Under the former Agricultural Community Modernization Promotion Act (amended by Act No. 2199, Jan. 12, 1970; Act No. 2 of the Addenda to the Farmland Improvement Association Act (amended by Act No. 5077, Dec. 29, 1995; hereinafter “former Agricultural Community Modernization Promotion Act”).

(2) Under Article 3 of the Addenda, the name of the Youngdong Farmland Improvement Association was changed to that of the Youngdong Farmland Improvement Association (No. 5759 of Feb. 5, 199), and the former Agricultural and Rural Infrastructure Corporation and Farmland Management Fund (No. 5759 of Feb. 5, 199), and the Korea Agricultural and Rural Infrastructure Corporation established on Jan. 1, 200 (Korea Agricultural and Rural Infrastructure Corporation) comprehensively succeeded to the rights and obligations of the "Ydong Farmland Improvement Association" under Article

3) Under Article 3 of the Addenda to the former Korea Rural Community & Agricultural Corporation and Farmland Management Fund Act (Act No. 7775 of Dec. 29, 2005), “Korea Rural Community & Agricultural Corporation” has changed the name into “Korea Rural Community & Agricultural Corporation,” and Article 3 of the Addenda to the former Korea Rural Community Corporation and Farmland Management Fund (Act No. 9276 of Dec. 29, 2008), respectively, to “Korea Rural Community Corporation,” and “Korea Rural Community Corporation,” respectively. (B) The construction, etc., of the instant reservoir was commenced in the Han River Repair Association (hereinafter “Korea Rural Community Corporation”) around 1956 and completed the construction work of the reservoir around 1963.

2. Since the construction of the reservoir in this case, the management affairs shall be the "Yandong Land Improvement Association" under Article 14 of the former Land Improvement Projects Act.
