A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
around February 4, 2007, the Defendant: (a) married with B on or around January 16, 2020; (b) applied for a divorce on or around January 16, 2020; (c) was in the current duration of mediation; and (d) in order to enter into a contract for goods transaction with D companies, “C”, a steel manufacturing and distribution company it operates, without permission of B, to enter into a goods transaction contract with D companies.
1. Around October 11, 2019, the Defendant: (a) purchased B’s passport and seal imprint; and (b) obtained B’s certificate of personal seal imprint from a house where B resides in Busan Metropolitan City; and (c) submitted B’s name column and address on the letter of proxy for issuance of a certificate of personal seal imprint; (b) indicated B’s resident registration number and address in the letter of proxy for issuance of a certificate of personal seal imprint; and (c) signed B’s name and attached B’s seal imprint; and (d) submitted it to the public official in charge of the above administrative welfare center where it is impossible to know the fact.
For the purpose of exercising, the Defendant forged and exercised a letter of proxy to issue a certificate of personal seal impression in the name of private document B, which is a private document related to rights and duties.
2. Forgery of private documents and uttering of documentary evidence - The defendant, at the above C office operated by the defendant in North-gu, Daegu-gu, Daegu-gu, Seoul-gu, on October 11, 2019, entered the “B” in the column of the name of the joint and several surety, entered the B’s resident registration number and address in the column of the name of the joint and several surety, affixed the seal imprint of B in advance in the name of B, and affixed the seal imprint of the said D’s name without knowing the fact.
