The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for not less than eight months.

Provided, That the above punishment shall be imposed for two years from the date of the final judgment.

1. The main point of the grounds for appeal is that the lower court’s punishment (ten months of imprisonment, two years of suspended sentence, two years of probation, one hundred and sixty hours of community service order, confiscation) is too unreasonable.

2. Prior to the judgment of the court below on the grounds for appeal by the defendant ex officio, the part that the defendant provided game products, the contents of which are different from the classification, for distribution or use, or displayed or stored for such purposes shall be considered ex officio.

The subject of classification prescribed by the Game Industry Promotion Act (hereinafter referred to as the "Game Industry Promotion Act") is the contents of game products or the program license itself, i.e., the contents of the game products or the description of the contents of the game products attached thereto.

Therefore, “providing game products with any content different from the rating obtained” under Article 32(1)2 of the Game Industry Act includes not only the act of changing the contents of an application for rating or an explanation attached thereto, but also the act of adding important functions not stated in the above application or explanation, but also the act of providing a separate external organ that is not likely to cause any change to the contents of the game product.
