Defendant shall be punished by a fine of KRW 3,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

On September 18, 2009, the Defendant was sentenced to one year for fabrication of private documents, uttering of falsified documents, and violation of the Road Traffic Act at the Busan District Court on September 26, 2009, and the judgment became final and conclusive on September 26, 2009. On December 8, 2009, the Busan District Court sentenced ten months of imprisonment for fraud or intimidation, and the judgment became final and conclusive on December 16, 2009. On June 22, 2012, the Defendant was sentenced to six months of imprisonment for fraud and became final and conclusive on June 30, 2012.

1. Forgery of private documents and uttering of a falsified investigation document concerning a water purifier siren contract;

가. 피고인은 2009. 3. 11.경 부산광역시 부산진구 B건물 904호에서 정수기(CHP-06EU) 1대를 ㈜웅진코웨이로부터 임차함에 있어 성명을 알 수 없는 직원에게 미리 알고 있던 C의 인적사항 등을 알려주어 렌탈(임대차)계약서에 계약처 고객명란에 “C”, 주민등록번호란에 “D”, 결제자 예금/회원명란에 “C”, 은행/카드사명란에 “05(외환은행)”, 계좌/카드번호란에 “E”이 기재되도록 한 후, 서명란에는 피고인의 친형인 F의 이름을 기재하고 그 옆에 서명을 하였다.

Accordingly, for the purpose of uttering, the Defendant forged a rental contract in the name of C, which is a private document on rights and obligations.

나. 피고인은 위 일시 경 위 장소에서 위조 사실을 모르는 위 ㈜웅진코웨이 직원에게 위와 같이 위조한 렌탈(임대차)계약서가 마치 진정하게 성립한 문서인 것처럼 교부하여 행사하였다.
