A defendant shall be punished by imprisonment for one year.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
From November 2008 to March 201, the Defendant: (a) used the fact that the victim C Co., Ltd. (the representative director D) performed the business of managing steel workers from November 2008 to March 201, the victim C Co., Ltd. (the victim C Co., Ltd.) under a contract from E to 20, the 4 high repair works; (b) the equipment construction works for the brine resource-making; (c) the 5 Co., Ltd. construction works; (d) the five small-scale factory construction works; (d) the construction works for the finite-scale maintenance works; and (e) the victim Co., Ltd., the victim did not confirm whether the steel workers actually worked for the steel workers; and (e) used the fact that the victim Co., Ltd. did not request for personnel expenses to obtain money from the victim Co., Ltd. under the name of F, G, H I, J, K, M, M, P, Q, Q, R; and (e) the victim.
1. On December 22, 2008, the Defendant, in the name of F workers, prepared a statement of payment of labor cost to the victim company as if the F had worked for 110,000 won per unit of labor cost from November 22, 2008 to November 29, 2008, at an office at the construction site where PCM capacity was increased by 2 cooling-si, U.S. employees, and received KRW 920,000 from F’s agricultural account around December 22, 2008 and received KRW 920,000,000 in total from F to June 26, 2009, as shown in the list of claims for labor cost from November 22, 2008.
2. On February 2, 2009, G in the name of G workers, the Defendant was guilty of false labor costs, at the second cooling PCM ability lectures works in U, fourth height repair work site offices, G in the list of claims for daily labor costs from January 2, 2009 to February 2, 2009.
1. By December 5, 120,000 won per unit price for labor costs until September 23, each of the 12.5 days, and as if the 110,000 won per unit price were for nine days, the on-site employee shall prepare a statement of payment of daily labor costs in G and then shall pay labor costs to the victim company.
