A defendant shall be punished by imprisonment for one year.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

On June 19, 2016, the defendant, who entered the Republic of Korea as a visiting employment visa (H-2) and stays in the Republic of Korea, obtained a certificate of national technical qualification as a witness information processing technician who is entrusted by the Human Resources Development Service of Korea from the Human Resources Development Service of Korea to obtain a certificate of national technical qualification, and has obtained a certificate of national technical qualification as a witness information processing technician who is implemented and issued by the Korea Technical Qualification Examination Service of Korea.

그러나 피고인은 한국어로 된 시험문제를 해석 및 풀이할 능력이 부족하여 고민하던 중, 지인으로부터 시험 문제를 대신 풀어 정답을 알려줄 브로커 C를 소개받아 휴대폰 어플 ‘위챗’을 통해 연락한 후, 합격할 경우 100만 원을 지불하기로 합의하여 부정한 방법으로 시험에 응시하기로 마음먹었다.
