A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On June 14, 2012, the Defendant was sentenced to three years of imprisonment by the Cheongju District Court for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and completed the execution of the sentence on March 31, 2015.
The defendant knew that money was deposited in the Agricultural Cooperative passbook (Account Number: E) in the name of C his possession and management of C, and asked C to confirm and manage the disability pension, etc. deposited in the above passbook, and he received the passbook and seal in the name of C from C, and then released money deposited in the passbook to use it.
1. On September 30, 2015, the Defendant forged a private document: (a) stated “E” in the column of “E” and “D” in the name column of “E” in the face value on the paper of the written request for a deposit kept at the center of Jinju, the agricultural community located in 1033, as of Jinju, Jinju, as of September 30, 2015; (b) stated “E” in the face value column, and received from “B” next to the name.
Along with D’s seal stamped from May 18, 2016 to May 14, 2016, the term “written request for deposit in the name of D, which is a private document on rights and obligations, for the purpose of exercising it over a total of 14 times, such as the list of crimes in the attached list of crimes.”
2. The Defendant, at the same time and at a place as set forth in paragraph 1, issued and used the forged request form as if it were a document duly formed to FF employees of the Nonghyup Bank, who knew of such forgery, and exercised the claim form for deposit in the name of D in total 14 times from that time to May 18, 2016, as shown in the attached list of crimes committed.
3. The criminal defendant presented one copy of a counterfeited request for deposit at the same time and time as above at the same time as in paragraph 1, and committed as if he/she had a legitimate right to manage D’s passbook, and at that women’s deposit passbook.
