A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. The Defendant, on July 7, 201, resided in the victim D’s house located in Nam-gu, Nam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Seoul, as a tenant.

At that time, while being hospitalized on July 28, 201 due to the aggravation of the health of the victim, the victim voluntarily released the deposit from the said passbook and used the deposit money to be used, upon receiving a request from the bank to return the passbook and seal.

Even after the completion of the duties such as the payment of public charges delegated by the injured party, the Defendant embezzled the above passbook and seal as it did not return it until November 4, 2015.

2. The Defendant, as described in paragraph 1, embezzled and kept a password of the AFC head and seal, with the same number as that of the AFC head and seal as indicated in paragraph 1, was willing to withdraw the deposit after forging a written request for deposit in the name of D through the AFC head and the AFC head.

On January 16, 2012, the Defendant entered “E” and “Twelve thousand won” in the account number column in the bank’s request form, which is kept at the first floor of the Daejeon Chungcheongnam-gu Seoul Special Metropolitan City, Seo-gu, Seocheon-gu, 82 welfare building at the 1st floor of the building, the Defendant: (a) stated “E” and “D” in the claim column; and (b) carried the name following the entry.

D’s seal shall be accompanied by forging one copy of a written request for a deposit in the name of D, a private document related to rights and obligations, and shall be issued and exercised as if the written request for a forged deposit was duly formed to an unsatisfying employee who may know of such fact, and as if he/she had a legitimate authority to withdraw the deposit, he/she shall in turn deceiving the said employee and receive 300,000 won for cash withdrawal, which is the ownership of the victim agricultural cooperative, from the place of the receipt of the deposit, as shown in the attached list of crimes.
