Reasons
Punishment of the crime
1. On February 7, 2013, the Defendant in violation of the Building Act and the National Land Planning and Utilization Act newly constructed a building in Kimhae-si B, the Defendant obtained approval for the use of a detached house and a neighborhood living facility with 225.17 square meters in a 1st floor office, 10 square meters in a stairs room, 200.67 square meters in a two-story multi-household house (two households), 200.67 square meters in a three-story multi-family house (two households), and 200.67 square meters in a three-story multi-story house (two households), and in the case of a housing site development project in accordance with the district unit plan for Kimbuk-gu, the said area is
Any person who intends to change the use of a building for which approval has been obtained shall obtain permission from or report to a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu, and any person who intends to construct or repair a building shall obtain permission from the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu
Nevertheless, on February 2013, the Defendant, without reporting to the Kimhae-si City Mayor, accumulated a boundary wall in the office of the first floor of the building in question, created each inner, toilet, outside entrance door, etc., and changed the purpose of use into 7 households in the house, and used 2 and 3 stories in each of the two households without obtaining permission from the Kimhae-si City Mayor, expanded the two households by using the aforementioned method, extending the 4th floor by using steel bars and concrete, thereby extending the 23 households in total, and at the same time, constructed and changed the use of a building that does not comply with the district unit plan for the land development project for the Kimbuk-do area.
Accordingly, the defendant changed the use of the building without reporting to the Kimhae City Mayor, constructed a building without obtaining permission from the Kimhae City Mayor, repaired the building, and does not comply with the district unit plan.
