A defendant shall be punished by imprisonment for a term of one year and eight months.
Seized evidence 1 through 6, 8 through 20 shall be confiscated, respectively.
Reasons
Punishment of the crime
On October 19, 2017, the Defendant was issued a summary order of a fine of three million won for the crime of violating the Electronic Financial Transactions Act with respect to the transfer of three copies of the physical card linked to his own account at the Busan District Court. On August 19, 2017, the Defendant was well aware that there was a record of the fact that part of the transferred physical card was used for the crime of fraud and was subject to the Seoul Central District Public Prosecutor’s Office’s decision of lack of evidence (defluence of suspicion) on August 9, 2017, when converting the phone number of a person without name into “010” using the core chip and relay.

The Defendant inserted a core chip, which had been sent by the non-member of his/her name during the relay period installed from October 2018 to January 17, 2019, and provided a telecommunications business operator with the phone number inserted in the above relay period by receiving Internet phone calls from the non-member of the Internet, and converting the phone number from the core chip inserted in the above relay period to the domestic number of 010.
