Reasons
Punishment of the crime
[2014 Height 1153] The Defendant and C conspired to purchase the leased vehicle under the name of another person and access D, who is the Defendant’s seat, to receive documents necessary for the purchase of the vehicle.
C will be used in finding again that around April 2013, D moved a vehicle under the name of the corporation it operates into the name of D in the name of two months.
In order to make a false statement, it received from D a copy of D's resident registration list, a copy of D's resident registration list, a copy of automobile driver's license, a copy of D's certificate, and a copy of D's personal registration certificate, and it is also possible to create a chapter for D's personal registration.
1. On April 25, 2013, the Defendant and C visited “F”, an imported automobile specialized company located in the Nam-gu Busan Metropolitan City, to enter the car sales contract in which the Defendant had the name of “G”, “101 Dong-gu H building 808,” “76,200,000 won in the vehicle price column,” “D” and “D” attached to the buyer’s name.
Then, the Defendant entered customer information, the applicant and the underwriter column as “D” in the application for the lease of a modern car in which he had been located, using the test color pen, and marks the above D’s seal impression which was created in advance following his name.
Accordingly, the Defendant, in collusion with C, committed each of the following acts: (a) a motor vehicle transaction contract in the name of D, which is a private document on rights and obligations; and (b) a lease application for a motor vehicle of Hyundai Capital Co., Ltd.
2. The Defendant and C in the event of the foregoing investigation document submitted a forged automobile trading contract to Franchis I who knew of the forgery at the time and place specified in paragraph 1.
Then, at the above place, C is a name-free member representing Hyundai Capital Co., Ltd. which may know the forgery at that time.
