A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

On October 4, 2018, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Incheon District Court. On January 24, 2019, the Incheon Detention House completed the enforcement of the sentence.

1. Embezzlements of lost possession;

A. On February 5, 2019, at around 23:00 to 23:30 on the same day, the Defendant, at the C Station located in Dong Government-si B, obtained the E- Card (F) owned by the victim D and did not take necessary procedures, such as returning it to the victim, and embezzled the property that he/she had, on his/her own mind, left from the possession of the victim.

B. Around 04:00 to 05:00 on February 19, 2019, the Defendant embezzled the property that he/she had on his/her own mind, without following necessary procedures, such as acquiring an E card (credit card number: H) owned by the victim G, and returning it to the victim, etc. in the nearest area of the said C Station, at around 05:00.

C. At around 20:00 on February 21, 2019, the Defendant, without following necessary procedures, embezzled the property that he/she had, on his/her own idea, derived from the victim’s possession, by acquiring the BC card (credit card number): L) owned by the victim K lost at the center of J Station located in the city of Jan Government-si I, and returning it to the victim.

On February 22, 2019, around 09:30, the Defendant embezzled the property that he/she had, as he/she had, obtained the victim’s physical check card (credit card number) from a P bank owned by the victim and returned it to the victim in the N Station located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, Incheon, without following necessary procedures.

E. On March 2, 2019, the Defendant, at around 13:00, arrived at the 4 lines of interest in the university of Jongno-gu Seoul, Jongno-gu, Seoul at a university of 120, and did not take necessary procedures, such as acquiring the BC card (credit card number (S) owned by the victim lost and returning it to the victim, and embezzled the property that he/she had, as he/she had, thought, left from the possession of the victim.
