A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On August 27, 2014, the Defendant was sentenced to imprisonment with labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Southern District Court on the Aggravated Punishment, etc. of Specific Crimes, and completed the execution of the said punishment on December 29, 2015.

"2016 Highest 3186"

1. Embezzlements of deserted articles in possession;

A. On May 3, 2016, the Defendant acquired one (credit number D) Samsung Card, which was owned by the Victim C, in the vicinity of Yeongdeungpo-dong, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu, Seoul, at around 13:00, around May 3, 2016.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

B. On May 23, 2016, the Defendant acquired one copy of the No. 3 Card (the card number F) owned by the victim E in the vicinity of Yeongdeungpopo-dong, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu, Seoul.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

On May 2016, the Defendant acquired one copy of the corporate bank physical card (credit number H) that was lost by the victim G in the vicinity of Yeongdeungpopo-dong, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu, Seoul.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

On April 5, 2016, the Defendant acquired one copy of the Cock Card (Credit Number J) of the Korean Bank, the victim I was lost in the vicinity of Yeongdeungpopo-dong, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu, Seoul.

The Defendant’s property acquired as above is the victim.
