A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[criminal power] On July 3, 2015, the Defendant was sentenced to 8 months of imprisonment with prison labor or 2 years of suspended execution for larceny, etc. by the Incheon District Court, and on July 11, 2015, the said judgment became final and conclusive and is still under suspended execution.

【Criminal Facts】

1. Embezzlements of lost possession;

A. At around 00:30 on July 12, 2015, the Defendant: (a) obtained one copy of the Victim C’s physical fitness card from a new bank owned by the victim C, which was lost on the street prior to the Guro-gu Incheon Metropolitan City, and did not follow necessary procedures, such as returning it to the victim; and (b) embezzled the property that he/she had on his/her thought to have, as he/she had, left the possession of the victim.

B. On July 1, 2015, at around 00:00, the Defendant acquired one copy of the resident registration certificate owned by the victim D, which was lost in front of the Roman-dong, Nam-gu, Incheon Metropolitan City, and embezzled the property that he/she had, on his/her idea, had, without following necessary procedures, such as returning it to the victim.

C. At around 21:00 on July 31, 2015, the Defendant: (a) obtained one copy of the Victim G from a pharmacy affiliated with the Yeonsu-gu Incheon, Yeonsu-gu, Incheon; and (b) did not follow necessary procedures, such as returning to the victim, and embezzled the property that he/she had, on his/her own idea, lost.

On August 1, 2015, the Defendant, at around 04:00, embezzled the property that he/she had on his/her own idea, without following necessary procedures, such as acquiring one copy of the physical card of a corporate bank owned by the victim H, which was lost in front of 2030-distance located in Nam-gu Incheon Metropolitan City, and returning it to the victim.

E. The Defendant, around 17:40 on August 6, 2015, obtained one copy of the Defendant’s physical card owned by the Victim I on the cash automatic withdrawal machine at the Namcheon-nam Branch of the Namcheon Agricultural Cooperatives located in Yeonsu-gu Incheon, Incheon, Seoul, and then came to acquire one copy of the Defendant’s physical card.
