1. The Defendant’s KRW 90,000,000 as well as 6% per annum from October 14, 2014 to April 23, 2015 to the Plaintiff.

Basic Facts

On March 21, 2014, the Defendant made a bid (hereinafter “instant bid”) to supply water, replace hot water pipes, and select companies appurtenant thereto (hereinafter “instant construction”) in Seongbuk-gu, Sungnam-si (hereinafter “instant apartment”), and decided on the proposal for the public announcement of tender.

On May 2, 2014, the Defendant announced the bidding by supplementing or modifying only the bidding schedule within the tender announcement bill as above through B, which is the head of the managing office of the apartment of this case. The main contents are as follows.

Water supply, replacement of water supply pipes, and public announcement of tender of appurtenant companies;

1. Outline of the complex;

(a) Location: A apartment in Seongbuk-gu, Sungnam-si, Gyeonggi-do;

(b) Size of a complex: 12 units, 1039 units, 15-25 floors;

2. Bidding details: Provision of detailed data in terms of water supply, replacement of hot water pipelines, and site descriptions on appurtenant works;

3. Qualifications for participation;

(a) An enterprise not falling under Article 2013-854 of the Ministry of Land, Infrastructure and Transport notification;

(b) An enterprise which registers its machinery and equipment construction business and has at least seven hundred million won in capital;

(c) Exclusion from the provision of water to two or more households in the joint principal book of 200 or more, or one or more households of 100 or more households, from the partial replacement of a business entity with the completion records of a water-supply pipe complete replacement (including a water-supply pipe), and from the subcontract performance;

(d) An enterprise which attends the site consultations council.

4. The outline of documents to be submitted (the outline);

(d) A report on the actual results or the certificate of actual results of an apartment in 2013 in the field of machinery and equipment construction business shall be issued by the Association, and an apartment performance certificate shall be clearly stated in the scope of the construction, the number of households and telephone numbers;

(e) Documents pursuant to the evaluation table of qualification examination under Article 6 (1) 1 of the Ministry of Land, Infrastructure and Transport Notice No. 2013-854;

(f) Tenders (excluding value-added tax) under attached Form 2 of the Ministry of Land, Infrastructure and Transport Notice No. 2013-854;

(g) Tender bond (written bid bond by not less than 5% of the bid price) and matters to be sealed and submitted separately;

5. Bidding schedule;

(a) The time limit for document registration: 14:00 on May 09, 2014, and the documents of paragraphs (a) through (d) above at the apartment management office of each party.
