Reasons
Punishment of the crime
On May 4, 2012, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Northern District Court, and the said judgment became final and conclusive on August 17, 2012.
1. At around 10:30 on August 31, 201, the Defendant forged private documents: (a) within Gangnam-gu Seoul Metropolitan Government B, and around 10:30 on August 31, 201, the Defendant: (b) opened “E” and “E” in the customer name column, “C” and “E” in the customer name column; and (c) signed on August 21, 201 on August 21, 201 in the application column.
As a result, the Defendant forged the “soleh Moble new application” and “ Soleh smartphone” in the name of “ Soleh Mobio”, which is a private document regarding the certification of facts.
2. At the time and place specified in paragraph (1) above, the Defendant: (a) submitted a forged application for a new Maleh Mobome and “loleh smartphone” to business operators D, who are aware of the forgery; and (b) held each of the aforementioned applications.
3. Although the Defendant did not obtain the consent of the new opening of the mobile phone from C at the time and place specified in the above Paragraph 1, the Defendant made a false statement to the victim D, who is a business employee, stating that “C does not have any guidance in the hospital, and instead, Handphones have been opened in lieu of the horses.” The Defendant obtained a smartphone equivalent to KRW 946,00 in the market price from the victim D and obtained it by deceiving it.
