Defendant shall be punished by imprisonment with prison labor of one year and six months and a fine of two million won.

The defendant does not pay the above fine.

Punishment of the crime

[2019 Highest 4646] On July 22, 2019, the Defendant posted a letter stating that “E,” which is an Internet intermediate trading site, sold for KRW 40,000,” and said that “on the basis of the confirmation of payment, the Defendant will send the article to the victim F, who made the contact.”

However, since the defendant did not have the above goods, there was no intention or ability to send the goods even if he received money from the victim.

Nevertheless, as above, the Defendant, as well as receiving 40,000 won from the victim’s account in the name of the Defendant on the same day to the G bank account in the name of the Defendant. From July 22, 2019 to September 19, 2019, a list of crimes committed in attached Form.

[2019 Highest 4996] On August 18, 2019, the Defendant posted a letter to the effect that “H will sell one household of 70,000 won,” which is an Internet intermediate trading site, at the Mayang-si building and the Defendant’s residence located in No. D, and said that “I will deliver the article to the victim I who contacted with it, if he transfers KRW 70,000 to J.”

However, since the defendant did not have the above goods, there was no intention or ability to send the goods even if he received money from the victim.

Nevertheless, the defendant deceivings the victim as above and acquired 70,000 won from the victim as J on the same day.

[2019 Highest 5492] Around August 27, 2019, the Defendant posted a letter stating that “The sale of Blus Slus Slus Slus Slus will be made by sending the goods to the victim M who reported and contacted this.”
