A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, around February 15, 2019, posted a false statement to the effect that “The Defendant would send the price to the home of the victim E, who visited the victim E, by accessing the Defendant’s home located in Daegu Suwon-gu, to D, a medium-sized Internet trading site, selling a dry-type model, such as “PGE-based mining,” and reporting it to the effect that “the Defendant would send the price to the home of the PGE-based goods.”
However, even if the defendant receives the payment from the victim, he did not have the intention or ability to send the above things.
Nevertheless, the Defendant deceiving the victim as above and received 200,000 won from the victim’s bank account (G) in the name of the Defendant on the same day, as well as from around that time to February 27, 2019 by deceiving the victims in a total of seven times, such as the statement in the annexed crime list, and then received a total of KRW 1,865,000 from the victims.
Accordingly, the defendant was provided property by deceiving the victims.
On October 15, 2019, the Defendant posted a false statement to the effect that “The 2019 Highest 5809” had access to D, which is an Internet trading site, and “the sales of Aphone X mobile phones,” and reported it to the victim B, who visited the victim B.
However, even if the defendant receives the payment from the victim, he did not have the intention or ability to send the above things.
The Defendant, by deceiving the victim as above, received 443,00 won from the victim’s H account under the name of the Defendant on the same day.
