A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 1716"

1. The Defendant, around May 10, 2019, posted a false statement to the effect that “The sale of cultural merchandise coupons shall be made” on the Internet Ekbook, and that “the sending of money to the victim B shall be made.”

However, the defendant did not have the goods to be delivered to the victim, and there was no intention or ability to deliver the goods to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received 50,000 won from the F Association account (Account Number: G) in the name of the Defendant as the price for the goods on the same day from the victim.

2. On August 4, 2019, the Defendant posted a false statement to the effect that, at his/her own residence located in the building C, the Defendant: (a) posted a mobile phone to the Internet Ekbbbbbbbbs box card; and (b) reported and contacted the victim H with the victim H, “if sending the money, sending the Lbbbs box card.”

However, the defendant did not have the goods to be delivered to the victim, and there was no intention or ability to deliver the goods to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, was transferred KRW 85,00 to the I Bank Account (Account Number: J) in the name of the Defendant at around 06:35 on the same day from the victim.

3. The Defendant, around September 2, 2019, posted a statement on the Defendant’s residence located in the building C in the Seoul Special Metropolitan City, Nowon-gu, Seoul Special Metropolitan City and posted a mobile phone to the Internet Ekbbbbbbs card, and sent the money to the victim K who reported and contacted the fact.
