A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

[205] Around March 1, 2020, the Defendant posted a false statement that “G” game accounts will be sold in KRW 60,000,000,000, by accessing the Internet EM (F), at the Domoto Domoto). The Defendant reported this false statement to the victim H who visited the Defendant.

However, the defendant did not have the above game account, so even if he received the money from the victim, he did not have the intention or ability to sell it.

As above, the Defendant, by deceiving the victim as above, received 60,000 won from the Agricultural Cooperative Account (Account Number: I) in the name of the Defendant on the same day from the victim, and received 2,071,000 won in total from February 8, 2020 to May 14, 2020 under the same name as indicated in the annexed crime list from February 8, 202 to May 14, 202.

[2020 Godan1448] On May 24, 2020, the Defendant posted a false statement that “K will sell the game account at KRW 3.60,00,000,” by accessing the Internet “J” website at Domo-si, Mamo-si, Mamo-si, and reported this.”

However, the defendant did not have the above game account, so even if he received money from the victim, he did not have the intention or ability to sell it.

Accordingly, the Defendant, by deceiving the victim as above, received 360,000 won from the victim to the Agricultural Cooperative (M) account under the name of the Defendant on the same day.

On August 31, 2019, the Defendant posted a false statement that “If deposited KRW 30,000,000, he will sell 50,000 fake game money” by accessing the Internet “O” website at an online store.” The Defendant reported this and sent a false statement that he would sell game money if deposited with the victim N.

However, the defendant did not intend to sell the above game money from the beginning.
