A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 11, 2020, the Defendant posted a false statement on “CPC Bank” located in Nam-gu Incheon Metropolitan Government B, stating that “I sell E Game money” by accessing “D” as an Internet site, and reported it to “I sell E Game money.” In order to transfer money to the victim F, I would like to sell money.

However, the defendant did not have the intent or ability to sell the game money by receiving money from the above victim.

Nevertheless, the Defendant, by deceiving the above victim, received KRW 93,00 from the said victim to the H bank account in the name of G.

On April 30, 2020, the Defendant posted a false statement to the effect that “I sell E-Game money” by accessing the Internet game community “J” at the Defendant’s home located in Nam-gu Incheon Metropolitan City, Nam-gu, 2020, and that “I sell E-Game money if I remitted money to K.”

However, in fact, the defendant did not have the above game money, and it was thought that he would use it for the repayment of personal debts, etc., and did not have an intention or ability to sell the game money which was promised to the above victim.

Nevertheless, the Defendant deceiving the above victim and received KRW 168,00 from the said victim for sales proceeds of game money on the same day as the above victim, and, from November 28, 2019 to April 30, 2020, by deceiving the victims on a total of six occasions, as shown in the attached crime list, and acquired the total amount of KRW 1,036,00.

On April 16, 2020, the Defendant posted a false statement to the effect that “the transfer of money would sell E Game money” by accessing the Internet game community at the Defendant’s home located in Nam-gu Incheon Metropolitan City, Nam-gu, and that “the transfer of money would sell E Game money.”
