A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On October 23, 2014, the Defendant was sentenced to a suspended sentence of four months for a violation of the Military Service Act by the Seoul Northern District Court on the violation of the Military Service Act, and the judgment becomes final and conclusive on the 31st of the same month.

"2015 Highest 4197"

1. On May 4, 2015, the Defendant forged private documents: (a) on the application form for mobile phone membership, the victim corporation, located at the same time in Nowon-gu, Seoul Special Metropolitan City, Nowon-gu, 215-38, the Defendant arbitrarily signed the name of the Defendant on his/her own, stating the name of the Defendant C in the applicant and his/her member column and the Defendant’s member column in his/her name.

Accordingly, the defendant forged the application form for mobile phone subscription in the name of C, which is a private document on rights and obligations for the purpose of uttering.

2. The Defendant, at the time, at a place specified in paragraph (1) and at a place, issued a forged mobile phone entrance application to D, who is an employee of the above store, who is aware of the forgery, as if it were the document duly formed.

3. The Defendant, at the date and time as stipulated in paragraph 1, presented one copy of the application form for the forged mobile phone admission at the same place, and instead, deceiving D as if he had a legitimate right to open the mobile phone in C’s name.

The Defendant received from the above D the amount equivalent to KRW 679,00 at the market price of 679,00,000, the victim owned by the Defendant.

1. On June 5, 2015, the Defendant forged a private document and the event of the aforementioned investigation document: (a) stated “G” in the “F agency located in Nowon-gu, Seoul Special Metropolitan City E” without authority for the purpose of exercising the document; (b) signed the application form for mobile phone membership in the “G” column; and (c) forged a copy of the application form for mobile phone membership in the name of G, a private document related to rights and obligations; and (d) forged the application form for a forged mobile phone membership with the name of the non-resident of the said agency who may know that the document was forged at the time.
